Frequently Asked Questions

What is the difference between contested and uncontested divorce?

An uncontested divorce happens when both parties agree on all major components and issues of a divorce, including guardianship, decision-making responsibility, child support, spousal support, and property division. This makes the divorce faster and less costly.

Contested divorces, on the other hand, are when the parties disagree on important issues and require court intervention to solve the dispute. Contested divorces can be both longer and more costly.

What are the legal requirements for a divorce?

There are three grounds to obtain a divorce.

These are:
• Physical or mental Cruelty
• Adultery
• Separation for at least one year

Separation for one year is required unless the claim is based on adultery or mental or physical cruelty, which allows for immediate filing. Adultery or physical and mental cruelty must be proven in court with evidence or affidavits.

How long does a divorce normally take?

The time to get a divorce will depend on a few things, but typically an uncontested divorce will take a few months to complete. If it is a contested divorce, it can take much longer because of the need for court and hearings.

Additionally, there's a mandatory 31-day waiting period after the divorce is granted before it becomes final.

What are my rights regarding spousal support?

Several factors will be considered by the court to determine your entitlement to spousal support. This includes history of care of the children, length of marriage and income of the parties.
